In a 2017 decision, the competent court, the Quebec Superior Court, cancelled the mortgage. P. has now appealed against that decision.
Scissorstone Paper, Schnick Schnack Schnuck or Ching Chang Chong. The game with the many names is so popular that it is even dedicated to an international holiday. It is on August 27 and was launched by the World Rock Paper Scissors Association.
The fact that you bet on scissor-stone paper doesn’t seem so unusual anymore when you look at the curiosities that were bet on in 2019.
Scissor-stone paper – luck or dexterity?
According to the Quebec Civil Code, it is only for skill and physical strength to be played, not to pure happiness. In addition, the amount set must not be excessive:
‘Game and betting contracts shall apply (…) where they relate to legitimate activities and games which require only the skill or physical exertion of the parties, unless the stake is excessive in the light of the circumstances and the conditions and means of the parties.’
Decision of 2017 confirmed
According to Judge Chantal Chatelain, scissor-stone paper can in fact be regarded as a game of skill in certain circumstances, particularly in terms of speed and strategy.
Nevertheless, it decided that the agreement between P. and H. was invalid because of the excessive amount of the bet.
In doing so, the judge upheld the 2017 ruling, which had reached a similar conclusion and ruled that the game in question was largely based on pure luck. In the previous judgment, the use of the game had already been considered excessive.
